Here’s the boring but important stuff. I do encourage people to have a read (they are the same T&Cs as when you book/sign at your session). I don’t like surprises so I’ve tried to make everything as clear, transparent, and fair to everyone. Terms & Conditions – Photography Session Agreement 1. This Photography Session Agreement must be signed prior to any photography commencing by a representative all parties present agree can sign on their behalf. 2. Guarantee100% money paid to Affinity Photography is refunded if you see no images you like during your Purchasing Appointment. Conditional upon – Your session must take place; A refund must be request within 24 hours of you first seeing your images; No images are chosen, ordered, nor supplied from your session; No images have been copied, downloaded, edited or used in any way, in part or in whole, by you now or in the future; No images were taken at or during the session by anyone other than the Affinity Photography photographer; No images digital or other formats, nor any product is supplied and all, if any, studio credit is forfeited; Images will not be available for future viewing nor choosing; Only money actually paid to Affinity Photography is refunded 3. Booking fee (aka Creation Fee) – a booking fee is required to secure the time and date of your Photography Session. This fee does not cover additional travel charges, postage, courier, photographer and others on-site parking fees, prop fees, venue fees and any other additional expenses occurred as a result of your Photography Session unless specifically stated in this Photography Session Agreement. 4. Studio Credit Any studio credit for a session must be used within 4 weeks of that session having taken place, Studio Credit can only be used for what it is stated for; Where studio credit has an expiry date, this must be used before the expiry date; Any and all credit may be forfeited if anyone other than the Affinity Photography photographer takes images during the portrait session. Studio Credit does not cover additional travel charges, postage, courier, photographer on-site parking fees, prop fees, venue fees and any other additional expenses occurred as a result of your Photography Session. Studio Credit is not redeemable for cash in whole or part. 5. Session Cancellation Policy – If you cancel a booked session date or request a refund, more than 7 days before the scheduled time and date of the portrait session, monies paid by you to Affinity Photography except a $50 cancellation fee, will be returned. If you cancel the booked session date or request a refund less than 7 days before the scheduled time and date of the portrait session, monies paid by you to Affinity Photography, less a $165 cancellation fee, will be returned ((or if using a fundraising voucher / studio credit, this will be forfeited) 6. Session Reschedule Policy - If you need to reschedule a session, we will of course, work with you in the fairest way for all parties. All rescheduling requires a substitute booked time and date. Not having a substitute booked time and date may be considered a cancellation (see policy above). If you need to rescheduling MORE THAN 7 days prior to your session, please contact Affinity Photography as soon as you know. As a small business, I really appreciate your consideration of my time and ability to offer last minute availability to other clients as soon as possible. Affinity Photography allows for 1 (ONE) only last minute reschedule (ie less than 7 day or less) due to COVID or illness without fee; Further rescheduling 7 days or less before the scheduled time and date of your portrait session may incur a $50 reschedule fee. 7. Travel charges may apply for distances further than 30km from Bentleigh, Victoria at the rate of $1 per km. 8. Should Affinity Photography and/or the photographer need to cancel or reschedule the Photography Session, you will be offered a refund of monies actually paid to Affinity Photography for the session if an alternative booking is not desired by you; 9. You acknowledge that the booking of and payment for any venue fees, props and the like, used for your Photography Session will be your responsibility; 10. Product orders, prints and reprints, will be at current studio prices at the time of ordering; Collection of any ordered products may be at the POP-UP Studio, or courier or postage at your expense. Postage of products will incur an additional charge. Studio credit cannot be used for postage. 11. Digital Image supply – Affinity Photography will supply a social media sized image (generally 2”x3” @ 100dpi) for each image purchased for sharing usage rights. This digital image will be supplied to you via download link once your purchase is complete. You have 7 days in which to download your digital images, an administration charge of $25 will apply if you do not download the images within the 7 days and request another link. Affinity Photography will not be responsible for the keeping and/or storage of any digital images taken during your session, including images chosen and paid for, once 3 months past the Photography Session has lapsed, and you acknowledge that after which time all the digital images may be destroyed without further notice; 12. Limitation of liability. Extreme professional care and diligence will be exercised in the performance of this booking. No warranty is expressed or implied and no guarantee is given for delivery of any specially requested images; Affinity Photography and/or the photographer’s entire liability for any claim, loss, damage or injury arising from or relating to this agreement and performance of this booking is limited to monies paid to Affinity Photography for this booking. In no event shall Affinity Photography and/or the photographer be liable for special, incidental, consequential or punitive damages in relation to this booking; Should mechanical failure, theft, accident or other mishap beyond reasonable control prevent the fulfilment of the assignment by Kaye Trathen and/or Affinity Photography, liability will be limited to refund of monies paid to Affinity Photography for this Photography Session. 13. Copyright and ownership of the photographic images remain the property of Kaye Trathen and may not be reproduced, sold or used for commercial purposes in any form without written permission from the copyright holder; 14. The professional service of Kaye Trathen is obtained with the unconditional understanding that she will be the only and exclusive photographer. No photographs can be taken during the session by the client or any members of the client’s party present during the session. This will void the Affinity Photography Guarantee Policy and possibly any studio credit. 15. You understand and consent that any of the images taken during this session may be used for advertising, marketing, display, editorial, competition, and/or exhibition purposes for Kaye Trathen and/or Affinity Photography.
